• Usage analytics and reporting

3. User Accounts

To access certain features of our services, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to disable any user account at our discretion.

4. Subscription and Billing

We offer various subscription tiers with different features and usage limits:

• Free Plan: 100 analyses per month, with InsightEmbed branding
• Starter Plan: 1,000 analyses per month at $9/month, with white-label option
• Pro Plan: 5,000 analyses per month at $29/month, with priority support

By subscribing to a paid plan, you agree to the following:

• You authorize us to charge your payment method on a recurring basis
• Subscription fees are billed in advance on a monthly basis
• No refunds will be issued for partial months of service
• Downgrading your subscription will take effect at the end of the current billing cycle
• You may cancel your subscription at any time, but no refunds will be provided for the current billing period

5. API Keys and Domain Validation

Our service requires the use of API keys to authenticate requests from your website. You agree to:

• Keep your API keys secure and confidential
• Use API keys only on authorized domains
• Not share your API keys with third parties
• Notify us immediately if you believe your API keys have been compromised

We validate domains to ensure the widget is used only on authorized websites. Using the widget on unauthorized domains is a violation of these terms.

6. Usage Restrictions

You agree not to use our services:

• In any way that violates any applicable laws or regulations
• To analyze, generate, or distribute harmful, abusive, or illegal content
• To harvest or collect personal information about users without their consent
• To impersonate or attempt to impersonate our company or employees
• To circumvent usage quotas or subscription limitations
• To engage in any activity that interferes with or disrupts our services
• To attempt to gain unauthorized access to our systems

7. Content Ownership and Responsibilities

When using our services, you retain ownership of your content and are responsible for:

• Ensuring you have the necessary rights to analyze and process content through our services
• Complying with all applicable laws regarding content on your website
• Not using our services to analyze content that infringes on intellectual property rights
• Not using our services for content that is illegal, harmful, or violates the rights of others

We do not claim ownership of the content you analyze through our services, but we may use anonymized data for service improvement.

8. Intellectual Property

All aspects of our services, including but not limited to the software, design, text, graphics, logos, and APIs, are protected by copyright, trademark, and other intellectual property laws. You agree not to:

• Modify, adapt, or hack our services
• Reverse engineer or decompile our software
• Remove any copyright or proprietary notices
• Use our services to build a similar or competitive product
• Copy, distribute, or reproduce our services without authorization

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall InsightEmbed be liable for any direct, indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with your use of our services.

We do not guarantee that:

• Our services will meet your specific requirements
• Our services will be uninterrupted, timely, secure, or error-free
• The results of using our services will be accurate or reliable
• Any errors in our software will be corrected

10. Indemnification

You agree to indemnify, defend, and hold harmless InsightEmbed, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses relating to or arising out of your use of our services, including but not limited to:

• Your violation of these Terms of Use
• Your violation of any rights of another party
• Your violation of any applicable laws, rules, or regulations
• Content submitted through your account
• Use of our widget on your website

11. Third-Party Services

Our services may integrate with or use third-party services, including:

• OpenAI API for content analysis
• Stripe for payment processing
• Puppeteer for screenshot functionality

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

12. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms of Use
• Violation of applicable laws
• Fraudulent, abusive, or harmful activities
• Non-payment of subscription fees
• Upon your request for account deletion

Upon termination, your right to use our services will immediately cease. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Modifications to Terms
